Terms of Service
These terms are the agreement between you and Engator for using the Engator Android app, the web dashboard at app.engator.io and the related services. By creating an account or using Engator, you agree to them. Please read them together with our Privacy Policy.
1. The service
Engator is an AI sales assistant for WhatsApp. It connects to your own WhatsApp number and replies to your customers in your voice, using the product information you give it. It also flags hot leads and hands chats back to you, runs paced campaigns, turns a photo of a contact list into leads, and keeps track of reminders and scheduled messages.
2. Your account
- You must be at least 18 and able to enter a contract. You must use Engator for your business or profession.
- Give us accurate details and keep your password safe. You are responsible for everything done through your account, including any extra numbers you add to it.
- Only connect WhatsApp numbers that you own or are authorised to use.
3. Trial and subscriptions
- Free trial: new accounts get a 14-day free trial, and you don't need a card to start. When the trial ends, Engator stops working for that account until you choose a paid plan.
- Billing: paid plans are subscriptions billed monthly in advance, through our payment processor Stripe, on the Engator website. They renew automatically until you cancel. Plan prices and limits are shown on the website when you subscribe. You can't buy a subscription inside the Android app.
- Cancelling: you can cancel any time from Billing in the web dashboard. You keep access until the end of the period you've already paid for, and you won't be charged again. You can undo a cancellation before that date.
- Closing your account ends any subscription immediately, not at the end of the period.
- Refunds: [CEO to confirm: e.g. "Fees already paid are non-refundable, except where the law requires otherwise."]
- Failed payments: if a payment fails, your account keeps working for a short grace period. If payment still isn't made after that, access is paused until it is.
- We may change prices or plans. If we do, we'll tell you before your next renewal, and the change will apply from that renewal.
4. Acceptable use
You are responsible for who you message and what you send. You agree not to use Engator to:
- send bulk unsolicited messages, or message people who have no reason to hear from you;
- contact anyone who has opted out. Engator keeps a do-not-contact list for you; don't work around it;
- send anything unlawful, deceptive, harassing, hateful or infringing, or promote illegal goods or services;
- impersonate someone else or mislead people about who they are talking to;
- break WhatsApp's terms and policies, or the laws that apply to you and your customers, including privacy, consumer protection, telemarketing and financial-promotion rules;
- interfere with the service, try to get around its limits or security, or reverse-engineer it, except where the law allows.
You must have a lawful basis, such as consent or an existing relationship, to contact the people whose numbers you add to Engator, and to let us process their data for you.
5. WhatsApp
Engator connects to your WhatsApp account as a linked device, or through Meta's WhatsApp Business Platform if you choose that option. Engator is independent and is not affiliated with, endorsed by or sponsored by WhatsApp or Meta.
WhatsApp sets its own rules and can restrict or suspend any number, including one used with Engator. Engator's pacing, sending hours and opt-out handling are there to reduce that risk, but we can't remove it. We are not responsible for actions WhatsApp or Meta take on your account.
6. AI replies
- Engator uses AI models to draft and send replies. AI can make mistakes. It might misunderstand a customer, state a price or detail wrongly, or answer something it shouldn't.
- Keep your product information accurate and check what Engator sends. In Co-pilot mode you approve each reply. In Autonomous mode replies are sent without your review, and you choose that mode at your own risk.
- You are responsible for every message sent from your number through Engator, whether you wrote it or the AI did.
7. Your content
You own the content you put into Engator: your product information, media, leads and conversations. You give us permission to store, process and send it only as needed to run the service for you, as described in our Privacy Policy. You confirm that you have the right to upload it.
8. Availability and changes
We work to keep Engator running reliably, but we provide it without any uptime guarantee. The service depends on WhatsApp, AI providers, hosting and other third parties outside our control. Maintenance, outages or changes by those parties can interrupt or limit it. We may change, add or remove features over time.
9. Suspension and termination
- You can close your account at any time, in the app under Settings → Delete account, or by emailing support. See Delete your account.
- We may suspend or close your account if you seriously or repeatedly break these terms. That includes sending unsolicited messages or ignoring opt-outs, failing to pay, or creating legal risk for us or others. Where reasonable, we'll warn you first.
- When your account closes, your right to use Engator ends. Sections 4, 6, 7 and 10 to 12 still apply after it closes.
10. Disclaimers and limitation of liability
Engator is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of AI output, or uninterrupted service.
To the extent the law allows, we are not liable for indirect, incidental or consequential losses. That includes lost sales, profits, data or reputation, and any loss from WhatsApp restricting your number or from messages sent through your account. Our total liability for any claim relating to Engator is limited to the amount you paid us in the 3 months before the claim arose.
You agree to cover our losses from claims by third parties, including your customers, that arise from your messages or from you breaking these terms.
Nothing in these terms limits liability that the law does not allow to be limited.
11. Governing law
These terms are governed by the laws of [UAE: CEO to confirm the jurisdiction]. Disputes will be settled by the courts of [CEO to confirm: e.g. Dubai], unless the law where you live gives you the right to bring a claim elsewhere.
12. Changes to these terms
We may update these terms. We'll change the effective date above. If a change is significant, we'll tell you by email or in the app before it takes effect. If you keep using Engator after that, you accept the new terms.
